Perfect Day LLC (“Perfect Day,” “we,” “us”) respects your privacy. This Privacy Policy
explains how we collect, use, disclose, and safeguard information when you access or use our
websites, mobile applications, products, and related services (collectively, the “Services”). By
using the Services, you agree to the practices described here and in our Terms of Service, which
incorporate this Policy by reference. Capitalized terms not defined here have the meanings given
in the Terms of Service.

linked with a particular person or household (“Personal Information”) collected through the
Services. It does not apply to the practices of companies we do not own or control, or to people
we do not manage.

When you use the Services, we automatically collect:
• Device & Usage Data: IP address, device identifiers, browser type, app version,
language, time zone, and activity within the Services (pages viewed, features used,
timestamps, crash logs, and diagnostics).
• Cookies & Similar Technologies: small data files placed on your device to recognize
your browser/app, remember settings, understand usage, and customize content. You can
control cookies via your browser or device settings; however, disabling cookies may limit
certain features.
We may use the data above to operate, maintain, and improve the Services; personalize your
experience; and understand how features are used.
2.3 Information from Third Parties
We may receive information about you from third parties, including:
• Service Providers and Partners (e.g., analytics, authentication, and payment partners);
• Connected Platforms you authorize us to access; and
• Publicly Available Sources.
3. How We Use Personal Information
We use Personal Information for the following purposes:
• Provide and Maintain the Services (including creating and managing accounts,
enabling features, and processing transactions);
• Personalize and Improve the Services (content, recommendations, and features);

• Account Information: Through your account settings, you may access, correct, or delete

change may evolve as the Services evolve.
• Account Deletion: You may request deletion of your account by contacting
info@perfectdaylive.com. Some information may persist in backups or as required by
law. We may continue to use aggregated or de‐identified data that does not identify you.

We retain Personal Information for as long as necessary to provide the Services, comply with our
legal obligations, resolve disputes, and enforce our agreements. Retention periods may vary
depending on the nature of the data and our legal or operational needs.
6. Children’s Privacy
As noted in the Terms, we do not knowingly collect personal information directly from children
under 13. If you are under 13, do not register for the Services or send us personal information. If
we learn that we have collected personal information from a child under 13, we will delete it
promptly. If you believe a child under 13 has provided personal information to us, contact
info@perfectdaylive.com.
We may collect information about children under 13 from parents, guardians, and/or caregivers
in order to provide the Services. COPPA does not restrict such collection from adults about their
children.
7. Third‐Party Links and Services
The Services may link to third‐party websites, apps, or services. We are not responsible for their
content or privacy practices. We encourage you to read their privacy policies.
8. Changes to This Policy
We may update this Policy periodically. If we make material changes, we will provide reasonable
notice (e.g., by posting to our website or sending an email/push notification). Your continued
use of the Services after the effective date of an update constitutes your acceptance of the
revised Policy. The use of information we collect is subject to the Policy in effect at the time
such information is used.

At Perfect Day, safeguarding your trust is our highest priority. We employ enterprise-grade
technologies and rigorous security protocols to ensure that every aspect of our platform is fast,
efficient, resilient, and highly secure. Our infrastructure and processes are continuously evaluated
against industry best practices, ensuring Perfect Day remains one of the most trusted solutions in
childcare engagement technology.
Data Security
All personal information is hosted on Amazon Web Services (AWS), a globally recognized leader in secure, compliant, cloud infrastructure. Data in transit is protected using Transport Layer Security (TLS) with 256-bit encryption. Strong authentication and access-control mechanisms further ensure that sensitive information remains private and protected at all times.
Information Access
Access to a student’s Perfect Day records is governed by strict role-based access controls
(RBAC). Only verified parents/guardians and authorized school/childcare staff can view a child’s information. Within each school, administrators maintain centralized control over staff permissions, ensuring only the appropriate personnel have access based on their role and responsibilities.
Privacy of Information
Perfect Day adheres to strict data minimization and privacy-by-design principles. All personal
information is encrypted both in transit and at rest, and we never sell or share data with unauthorized third parties. Information is used exclusively in accordance with our Privacy Policy. Schools and childcare centers maintain full control of their uploaded data and may request exports or deletions at any time in compliance with applicable privacy regulations.
Billing & Subscription Information
Live Monitoring Screenshot Prevention & Detection For Privacy
Perfect Day’s Live Monitoring WebCam feature is streamed in real time and designed with
privacy-first architecture. Our software protects the privacy of children in the childcare facility.
Our Terms of Service prohibit users from taking screenshots or recordings of video streaming
from your facility. As an added safeguard, software functions to protect against and detect users
who take still screenshots or video recordings while using Perfect Day Live.
For IOS and Android: The software detects when a screenshot is taken within the app and
displays a message indicating that screenshots are a violation of our terms of service and will
display a black screen.

PLEASE READ CAREFULLY. BY ACCESSING OR USING ANY OF OUR WEBSITES, APPLICATIONS, PRODUCTS, OR SERVICES (COLLECTIVELY, the “Services”), YOU AGREE TO BE BOUND BY THESE TERMS OF SERVICE (the “Terms”). IF YOU DO NOT AGREE, DO NOT USE THE SERVICES.
1. Who We Are and How to Reach Us
All subscriptions to Perfect Day are managed securely through the Apple App Store or Google
Play Store. These platforms use their own industry-leading payment infrastructures to process
transactions and protect sensitive financial data. Perfect Day never has direct access to your
credit card or banking information.
Families subscribing through the app stores also benefit from the multi-factor authentication
(MFA) and fraud-prevention safeguards built into Apple and Google’s ecosystems, adding an
extra layer of security and reliability to every transaction.
These Terms are a binding contract between you and Perfect Day LLC (“Perfect Day,” “we,”

2. Changes to These Terms
We continually work to improve our Services and may update these Terms from time to time. If
we make material changes, we will use reasonable efforts to notify you (e.g., by posting a notice
on our site or sending an email/push notification). Your continued use of the Services after
changes become effective constitutes acceptance of the revised Terms. If you do not agree to
the revised Terms, you must stop using the Services.
Except for changes made by us as described above, no other amendment or modification of these
Terms is effective unless in writing and signed by you and Perfect Day.
3. Eligibility; Accounts and Security
• You must be of legal age in your jurisdiction to form a binding contract. If you are
agreeing to these Terms on behalf of an organization, you represent and warrant that you
have authority to bind that organization, and references to “you” will mean that
organization.
• You may be required to create an account and select a password and username (your
“Perfect Day User ID”). Provide accurate, complete information and keep it updated.
• Do not use a User ID you do not have the right to use or another person’s name with the
intent to impersonate.
• You are responsible for maintaining the confidentiality of your account credentials and
for all activity under your account.
• You may not transfer your account without our prior written permission.
• You represent that your use of the Services complies with all applicable laws and
regulations. If applicable law prohibits your use of the Services, you are not authorized to
use them.
4. Subscription Plans, Billing, and Trials
4.1 Plans and Pricing
We offer paid subscription packages for access to certain features:
• Premium: $6.00/week – includes Limited HD Live Streaming, a social-style activity
feed (photos/videos), direct messaging with the school and teachers, contactless check-in/
out, schedules and events, and support for up to two (4) users.
• Ultimate: $10.00/week – includes all Premium features plus Unlimited HD live
streaming from your child’s classroom, Room to Room Facelink, Memories photo
gallery and support for up to four (6) users.
Prices are in U.S. dollars and may vary by region due to taxes or marketplace policies.
4.2 Free Trial
New customers may be eligible for a one-week free trial on Perfect Days’s Ultimate plan. A
valid payment method is required to start the trial. Unless you cancel before the trial ends,
your selected plan will automatically convert to a paid weekly subscription and your
payment method will be charged. During the trial you typically have access to the Ultimate
plan; after the trial, you will transition to the plan you selected for continued use.
4.3 Billing; Automatic Renewal; In‐App Purchases
Subscriptions automatically renew weekly on the same day each period ends. Billing is
processed through in‐app purchase using the payment method associated with your Apple App
Store or Google Play account, subject to the applicable marketplace terms (e.g., Apple Media
Services Terms, Google Play Terms of Service, and their respective standard EULA terms). By
subscribing, you authorize the applicable marketplace to charge your payment method on a
recurring basis until you cancel.
4.4 Cancellation & Refunds
You may cancel at any time through your device’s subscription settings (e.g., App Store or
Google Play). Primary account holder/user is required to cancel subscription via App Store or
Google Play. Cancellation takes effect at the next billing cycle; access continues until the end of
the current paid period. Unless required by law or marketplace policy, we do not provide
refunds for partial periods or unwatched content. Any refunds, if available, are issued solely by
the marketplace in accordance with its policies.
4.5 Price Changes
We may modify subscription prices. We will provide notice (e.g., push notification, in‐app
message, or marketplace notice) as required. Price changes take effect at the start of the next
subscription period after notice. If you do not agree to the change, cancel before the new price
takes effect.
4.6 Service Modifications
We may add, change, or remove features of the subscribed Services. Material changes will be
communicated via reasonable notice methods. Your continued use after notice constitutes
acceptance of the changes.
5. Mobile Applications; App Store Terms
These Terms apply to all Services, including our iOS and Android applications (each, an
“Application”). The following additional terms apply for apps obtained from an app
marketplace (each, a “Marketplace”):
1. These Terms are between you and Perfect Day, not the Marketplace. The Marketplace is
not responsible for the Application or its content.
2. The Application is licensed (not sold) to you on a limited, non‐exclusive,
non‐transferable, non‐sublicensable basis for your personal, non‐commercial use, subject
to these Terms and the Marketplace’s terms.
3. You will only use the Application on devices you own or control.
4. The Marketplace has no obligation to furnish maintenance or support for the Application.
5. In the event of any failure of the Application to conform to an applicable warranty, your
sole remedy may be a refund of the purchase price (if any) from the Marketplace.
6. Perfect Day (not the Marketplace) is responsible for addressing any claims relating to the
Application or your use thereof, including product liability claims and intellectual
property claims.
7. You represent that you are not located in a country subject to a U.S. Government
embargo and are not on any U.S. Government list of prohibited or restricted parties.
8. You must comply with applicable third‐party terms of agreement when using the
Application.
9. The Marketplace and its subsidiaries are third‐party beneficiaries of this Section and may
enforce it against you.
7. Ownership; Rights in the Services
The Services and all materials displayed, performed, or available through them—including text,
graphics, data, articles, photos, images, illustrations, and User Submissions (collectively,
“Content”)—are protected by intellectual property laws. You must comply with all notices and
restrictions associated with the Content.
You may not modify, publish, transmit, sell, create derivative works of, or otherwise exploit the
Services or Content except as expressly permitted in these Terms or by the Content owner. Some
parts of the Services may allow you to download a copy of certain Content for your personal use
—that functionality does not waive any restrictions.
8. Acceptable Use; Prohibited Conduct
You agree not to:
a. Infringe or violate any intellectual property or other rights of any person (including Perfect
Day);
b. Violate any law or regulation (including export control laws);
c. Post or transmit anything harmful, fraudulent, deceptive, threatening, harassing, defamatory,
obscene, or otherwise objectionable;
d. Jeopardize the security of your account or any other account;
e. Attempt to obtain passwords or other security information from any user;
f. Violate the security of any network, or attempt to crack passwords or security encryption
codes;
g. Run mailing lists, listservs, auto‐responders, or other processes that run while you are not
logged in, or otherwise interfere with the proper working of the Services (including by placing an
unreasonable load on our infrastructure);
h. Crawl, scrape, or spider any page or portion of the Services or Content (manually or by
automated means);
i. Copy or store any significant portion of the Content; or
j. Decompile, reverse engineer, or otherwise attempt to obtain the source code or underlying
ideas of the Services.
Violation of this Section may result in suspension or termination of your access to the Services.
9. Changes to the Services
We may change, suspend, or discontinue any part of the Services at any time. We may introduce
new features, impose limits on features, or restrict access to parts or all of the Services. Where
practical, we will try to provide notice of material changes that would adversely affect you. We
may remove any Content at any time for any reason in our sole discretion.
10. Termination
We may suspend or terminate your account or access to the Services at our discretion, including
for violation of these Terms. Account termination may result in deletion of Content associated
with your account. Where feasible, we will try to provide advance notice so that you can retrieve
important User Submissions, subject to law and these Terms.
If you believe you deleted your account by mistake, contact info@perfectdaylive.com. We will
try to help but cannot guarantee recovery.
Sections that by their nature should survive termination will survive, including payment
obligations, ownership, warranty disclaimers, limitations of liability, indemnities, and dispute
terms.

THE SERVICES AND CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, PERFECT DAY AND ITS LICENSORS AND SUPPLIERS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON‐INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR‐FREE OR THAT DEFECTS WILL BE CORRECTED.
SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
13. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, UNDER NO LEGAL THEORY (INCLUDING TORT, CONTRACT, STRICT LIABILITY, OR OTHERWISE) WILL PERFECT DAY (OR ITS LICENSORS OR SUPPLIERS) BE LIABLE TO YOU FOR: (A) ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES
(INCLUDING LOST PROFITS, LOSS OF GOODWILL, WORK STOPPAGE, ACCURACY OF RESULTS, OR COMPUTER FAILURE); OR (B) ANY AMOUNT, IN THE AGGREGATE, EXCEEDING THE GREATER OF: (I) $100; (II) THE AMOUNTS YOU PAID TO PERFECT DAY FOR THE SERVICES IN THE TWELVE (12) MONTHS PRECEDING THE
CLAIM; OR (III) ANY MATTER BEYOND OUR REASONABLE CONTROL. SOME JURISDICTIONS DO NOT ALLOW EXCLUSIONS OR LIMITATIONS OF CERTAIN DAMAGES, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
14. Indemnification
You agree to defend, indemnify, and hold harmless Perfect Day and our affiliates, officers,
agents, employees, and partners from and against any claims, liabilities, damages, losses, and
expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the
Services (including actions taken by a third party using your account), or (b) your violation of
these Terms. We will attempt to notify you of any claim for which we seek indemnification;
failure to provide notice does not relieve your obligations unless materially prejudicial.
15. SMS Terms
1. Perfect Day may send SMS messages to users for authentication, informational
notifications, and reminders.
2. You may cancel SMS at any time by replying STOP to the message thread you wish to
unsubscribe from. We will confirm by SMS that you have been unsubscribed for that use
case.
3. If you experience issues, contact support@perfectdaylive.com.
4. Carriers are not liable for delayed or undelivered messages.
5. Message and data rates may apply. Message frequency varies based on features you
enable.

16. Miscellaneous
• Taxes. You are responsible for paying, withholding, filing, and reporting all taxes, duties,
and other governmental assessments associated with your activity in connection with the
Services, except to the extent we choose to handle such obligations.
• Assignment. You may not assign or transfer these Terms, your rights, or your account
without our prior written consent. We may transfer or assign these Terms without
restriction.
• No Waiver. A failure to enforce any provision is not a waiver of our right to do so later.
• Severability. If any provision is found unenforceable, it will be modified to the minimum
extent necessary to make it enforceable, and the remaining provisions will remain in
effect.
• Entire Agreement. These Terms are the complete and exclusive statement of the
agreement between you and Perfect Day regarding the Services, superseding all prior or
contemporaneous agreements on this subject. Except as expressly stated in Section 6
(Marketplace), there are no third‐party beneficiaries.
• Electronic Communications. You consent to receive communications from us
electronically and agree that such communications satisfy any legal requirement that they
be in writing.

Warranty Disclaimer. Neither Perfect Day nor its licensors or suppliers makes any representations or warranties concerning any content contained in or accessed through the Services, and we will not be responsible or liable for the accuracy, copyright compliance, legality, or decency of material contained in or accessed through the Services. We (and our licensors and suppliers) make no representations or warranties regarding suggestions or recommendations of services or products offered or purchased through the Services. THE SERVICES AND CONTENT ARE PROVIDED BY Perfect Day (AND ITS LICENSORS AND SUPPLIERS) ON AN “AS-IS” BASIS WITHOUT WARRANTIES OR ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGMENT, OR THAT USE OF THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE. SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. Limitation of Liability. TO THE FULLEST EXTENT ALLOWED BY APPLICABLE LAW, UNDER NO CIRCUMSTANCES AND UNDER NO LEGAL THEORY (INCLUDING, WITHOUT LIMITATION, TORT, CONTRACT, STRICT LIABILITY, OR OTHERWISE) SHALL Perfect Day (OR ITS LICENSORS OR SUPPLIERS) BE LIABLE TO YOU OR TO ANY OTHER PERSON FOR (A) ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING DAMAGES FOR LOST PROFITS, LOSS OF GOODWILL, WORK STOPPAGE, ACCURACY OF RESULTS, OR COMPUTER FAILURE OR MALFUNCTION, OR (B) ANY AMOUNT, IN THE AGGREGATE, IN EXCESS OF THE GREATER OF (I) $100 OR (II) THE AMOUNTS PAID BY YOU TO Perfect Day IN CONNECTION WITH THE SERVICES IN THE TWELVE (12) – MONTH PERIOD PRECEDING THIS APPLICABLE CLAIM, OR (III) ANY MATTER BEYOND OUR REASONABLE CONTROL. Indemnity. You agree to indemnify and hold Perfect Day, its affiliates, officers, agents, employees, and partners harmless from and against any and all claims, liabilities, damages (actual and consequential), losses and expenses (including attorneys’ fees) arising from or in any way related to any third party claims relating to (a) your use of the Services (including any actions taken by a third party using your account), and (b) your violation of these Terms. In the event of such a claim, suit, or action (“Claim”)we will attempt to provide notice of the Claim to the contact information we have for your account (provided that failure to deliver such notice shall not eliminate or reduce your indemnification obligations hereunder). Assignment. You may not assign, delegate or transfer these Terms or your rights or obligations hereunder, or your Services account, in any way (by operation of law or otherwise) without Perfect Day’s prior written consent. We may transfer, assign, or delegate these Terms and our rights and obligations without consent.
Miscellaneous. You will be responsible for paying, withholding, filing, and reporting all taxes, duties, and other governmental assessments associated with your activity in connection with the Services, provided that Perfect Day may, in its sole discretion, do any of the foregoing on your behalf or for itself as it sees fit. The failure of either you or us to exercise, in any way, any right herein shall not be deemed a waiver of any further rights hereunder. If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated, to the minimum extent necessary, so that these Terms shall otherwise remain in full force and effect and enforceable. You and Perfect Day agree that these Terms are the complete and exclusive statement of the mutual understanding between you and Perfect Day, and that it supersedes and cancels all previous written and oral agreements, communications and other understandings relating to the subject matter of these Terms. You hereby acknowledge and agree that you are not an employee, agent, partner, or joint venture of Perfect Day, and you do not have any authority of any kind to bind Perfect Day in any respect whatsoever. Except as expressly set forth in the section above regarding the Apple Application, you and Perfect Day agree there are no third-party beneficiaries intended under these Terms.
